TERMS OF SERVICE
General ordering conditions of OHLI OÜ (Registry code 14063843, location: Toompuiestee 21, Tallinn 10137).
General ordering conditions are valid for the legal relations generated upon ordering goods on OHLI webpage https://ohli.life (hereinafter referred to as Webpage) through the ordering environment (hereinafter referred to as the Webshop).
In addition to these general ordering conditions, the relations between the Client and OHLI OÜ are regulated by the legal norms valid in the Republic of Estonia, the price list of Products of the Webshop and established good practice.
These general ordering conditions and the valid price list of Products of the Webshop are available on the webpage of OHLI.
All personal data related to payments is processed by Ohli OÜ. All data required to fulfill payments is shared wit the licensed payment partner Maksekeskus AS.
Procedure for ordering the Products
1.1 The Client does not have to register as a user of the Webshop for ordering the Products.
1.2 The Client chooses the desired Product(s), specifies the amount of each Product, the form of payment for the Products and the form of delivery of the Products. Before the final confirmation of the order the Client can review the order and change the submitted order. The Client shall confirm the order after reviewing the order. The order can be submitted in Estonian, Swedish or in English.
1.2.1 Submitting the order
For creating an order the Client has to add the product in the shopping cart. For submitting the order the necessary data fields on the order form need to be filled and the suitable means of transportation selected. Thereafter the amount payable is projected on the screen, which can be paid either through the bank links or through other means of payment. The purchase contract comes in act from the moment the paid amount is received at the seller´s webshop account. If the ordered products cannot be delivered due to that the products are out of stock or for some other reason, the Client will be notified about this in the first chance and the paid amount (incl. transportation costs) will be repaid immediately, but no later than 14 days after the notification.
OHLI OÜ is the responsible processor of personal data, OHLI OÜ forwards the personal data
necessary for making payments to the authorized processor Maksekeskus AS.
1.3 The prices of the Products indicated in the Webshop are in EUR and SEK and value added tax is included in the price.
1.4 The fee for delivery will be added to the price of the ordered Products according to the form of delivery selected by the Client.
1.5 The order confirmed by the Client can be paid through the Internet bank link and by credit cards. In paying for the Products the beneficiary of the payment is Maksekeskus AS, who has been authorised by OHLI OÜ to receive payments on their behalf.
1.6 The contract between the Client and OHLI OÜ is considered concluded after the Client has confirmed the Order by clicking on the button “Pay” and OHLI OÜ has sent the Order confirmation to the Client.
1.7 The Order takes effect by the consignment of the Product by OHLI OÜ to the Client.
Delivery of the Products
2.1 OHLI OÜ delivers the ordered Products to the Client according to the form of delivery selected by the Client upon submitting the order: either to a parcel machine or to a post office.
2.2 The Client shall select the form of delivery upon drafting the order. The prices of delivery are fixed in the price list, which is visible to the Client upon drafting the Order.
2.3 Period of delivery of the Products:
2.3.1 The Product shall be delivered to the provider of the transport service within 3-5 business days. The times of delivery indicated in the Webshop are valid only for deliveries within the borders of the Republic of Estonia. For deliveries abroad, please see article 2.6.
2.4 Forms of delivery of the Products
2.4.1 Omniva/Smartpost delivers the Product(s) to the parcel machine selected by the Client within the borders of Estonia as follows:
Upon arrival of the order to the parcel machine, a message will be sent to the mobile phone and e-mail of the Client containing the location of the parcel machine, opening times and a personal parcel code. Upon entering the code on the touch screen of the parcel machine, paying for the order by card, if applicable, the door of the parcel machine opens and the Client receives the parcel. The parcels are stored for free in the parcel machine for 7 calendar days after sending the message to the mobile phone and e-mail of the Client.
2.4.2 The parcel will reach the post office of Eesti Post within the borders of Estonia within 3-5 business days. The parcel shall be stored in the post office for 15 calendar days. After this period the parcel shall be returned to the sender by Eesti Post. A fee for storage is charged only, if the Client has asked to store the parcel in the post office for more than 15 calendar days. If the Client has not picked up the parcel from the post office within 15 calendar days nor asked to store it for a longer period, the order shall be subject to cancellation.
2.5 Ordering and delivery to outside the Republic of Estonia
2.5.1 OHLI OÜ offers a possibility to order Products to outside the Republic of Estonia. The prices for ordering abroad will be displayed in the Webshop upon drafting the order. The ordered products shall be delivered by OHLI OÜ to the Client to the address entered upon the submission of the order through a post office. The Product shall be delivered to the provider of the transport service within 3 business days.
2.6 Products can be ordered from OHLI OÜ webshop to the following countries: EU membership countries. Deliveries outside the Republic of Estonia usually take 14 calendar days. In special occasions there remains the right of delivery within 45 calendar days.
- The right of withdrawal from the order of Products by the Customer
3.1 The Client who is a Customer (hereinafter referred to as the Customer) has the right of withdrawal from the order of Products without giving a reason from placing the order until during 14 calendar days following the receipt of the Products.
3.2 For withdrawal from the order the Customer shall submit an application for withdrawal in writing or by e-mail to OHLI OÜ.
3.3 In the application for withdrawal the Customer shall indicate the number of the bank account and the name of the holder of the bank account, where the money to be returned shall be transferred.
3.4 If the Customer withdraws from the order, the Customer obliges to return unused and unharmed Products immediately, but no later than within 14 calendar days from the submission of the application for withdrawal. The Customer shall cover the costs of returning the Products upon withdrawal from the order.
3.6 OHLI OÜ shall return the amount paid for the Products to the Customer, the amount corresponding to the amount paid by the Client. OHLI OÜ shall return the money within 14 calendar days at the latest from the receipt of the application for withdrawal, but not sooner than within 3 working days from the receipt of the Products returned by the Client. OHLI OÜ shall return the costs of dispatch in full amount to the Customer, if the reason for withdrawal is a defective Product.
Rights of the Client
4.1 The Client has the right to order Products from the Webshop for the price and on the conditions specified by OHLI OÜ.
4.2 The Product sent to the Client shall be correct and correspond to the conditions fixed by OHLI OÜ.
4.3 The Client has the right to submit complaints concerning the order of the Product and the Product itself at the address Toompuiestee 21, 10137 Tallinn, Estonia or by e-mail to contact@ohli.life within 14 calendar days from the receipt of the Product.
4.4. In case of the non-conformity of the Product to the contractual conditions the Client has the right to rely upon legal remedies stipulated by the law.
- Obligations of the Client
5.1 Upon drafting the order the Client is obliged to submit the information necessary for the execution of the order: given name and surname, address of delivery, contact phone number and if possible, e-mail address.
5.2 If the Client and the recipient of the Product are different, the Client shall submit the information indicated in article 6.1 also for the recipient.
5.3 In case if the information submitted by the Client is incorrect and/or incomplete and do not correspond to the requirements of article 5.1, OHLI OÜ shall not guarantee the due execution of the order of the Product. If possible, OHLI OÜ shall contact the Client to specify the incorrect or incomplete information.
5.4 Upon drafting the order the Client confirms that s/he agrees with the conditions stipulated in the general ordering conditions and obliges to comply with them.
- Rights of OHLI OÜ
6.1 OHLI OÜ has the right to amend these general ordering conditions without prior notification by publishing the new valid conditions on the Webpage.
6.2 OHLI OÜ has the right at all times without prior notification to alter the price list of the Webshop by publishing a new price list on the Webpage.
6.3 OHLI OÜ has the right to waive the acceptance of an order or waive the execution of an order.
6.4 In case if the Client does not comply with the obligations implied on him/her by these general ordering conditions, OHLI OÜ shall not guarantee the execution of the order and/or the due delivery of the Product.
6.5 In case if the Client does not duly comply with the payment obligation, OHLI OÜ has the right to publish the information of the Client in the credit register.
- Obligations of OHLI OÜ
7.1 OHLI OÜ obliges to deliver to the Client correct and complete Product(s).
7.2 OHLI OÜ obliges to receive and document all complaints of the Client.
7.3 OHLI OÜ obliges to solve the complaint of the Client within 7 business days, if the causes of the complaint are independent of the Client. If the reason for the complaint has been caused by the Client, the Client shall immediately eliminate it.
7.4 OHLI OÜ obliges to replace defective items of the Products. OHLI OÜ shall be liable only for the manufacturing defects and other defects that were existent upon delivery of the Product to the Client.
7.5. All disputes between the parties shall be settled by negotiations. If an agreement is not reached and the Client wishes to continue with the submission of the complaint, the Client has the right to turn to the Consumer Disputes Committee of the Consumer Protection Board at the address Rahukohtu 2, Tallinn 10130.
